2006 LDA House of Delegates Resolutions

RESOLUTION  #1   
ADOPTED
(as amended) RESOLVED, that the LDA shall oppose any legislation with the restrictions or guidelines less restrictive than those proposed in Attachment 1-B draft legislation for General Supervision.  Any future changes in the rules governing General Supervision must first be approved by the LDA House of Delegates to have full LDA support. FINANCIAL IMPLICATION:   – $ 0 –

RESOLUTION  #2  
ADOPTED RESOLVED,
that the LDA oppose the proposed rule change of the LSBD to require specialists to spend a minimum 16 hours per month in that practice in order for the practice to advertise that they have this specialist. FINANCIAL IMPLICATION: – $ 0 –

RESOLUTION  #3                 
ADOPTED RESOLVED, that the LDA oppose an increase in licensing fees from the Louisiana State Board of Dentistry until the end of 2007 with a request for further information on the LSBD’s budgetary needs. FINANCIAL IMPLICATION:   – $ 0 –

RESOLUTION  #4    

ADOPTED RESOLVED, that the LDA supports the LSBD putting in place procedures for the delaying of nominations [for seats on the LSBD] to the governor in the event he/she declares a state of emergency and for approving expedited procedures for issuing provisional licenses to dentists and dental hygienists displaced by an emergency declared by the federal government.

ADOPTED
RESOLVED, to support the retired volunteer dental license legislation. FINANCIAL IMPLICATION:  – $ 0 –

 

RESOLUTION  #6

ADOPTED RESOLVED, to monitor the Prescription Monitoring Program legislation to ensure that the portion of the draft legislation stipulating that an authorized practitioner who dispenses or distributes no more than a 48-hour supply of such substances to his/her patients will not be considered a dispenser and will therefore not be affected by the proposed legislation remains in the bill. FINANCIAL IMPLICATION:   – $ 0 –

RESOLUTION  #7  
ADOPTED RESOLVED,
to support legislation requiring insurers to honor assignment of benefits as part of the LDA’s 2007 legislative agenda. FINANCIAL IMPLICATION: – $ 0 –
 

RESOLUTION  #8    
ADOPTED  (as amended) RESOLVED, that the LDA support and encourage the Louisiana State Board of Dentistry to accept both national or regional board exams.

RESOLUTION  #9    
ADOPTED RESOLVED
, to support the LSBD’s proposed legislation amending the range/schedule of fees and costs [pertaining to examination fees]. FINANCIAL IMPLICATION:  – $ 0 –

RESOLUTION #10          

ADOPTED RESOLVED, that, in the event multiple continuing education programs shall be presented at the LDA Annual Session, Resolution #2 of the 1999 LDA House of Delegates shall not be construed to apply to all the continuing education programs presented at the LDA Annual Session and, provided that at least one such seminar is of clinical subject matter, additional courses, should they be offered, may cover any topic deemed appropriate by the Council on LDA Sessions. FINANCIAL IMPLICATION:   – +$ 20,000 (est.) – 

RESOLUTION #11 

ADOPTED (House of Delegates) RESOLVED, that the manual Committees and Councils of the Louisiana Dental Association be amended by the inclusion of a new standing committee to be responsible for the planning and programming of the LDA Annual Sessions and to be called the Council on LDA Sessions, and be it further resolved…

RESOLVED, that in addition to a representative from each component as is standard for LDA standing committees, the council shall have two additional members to be appointed by the LDA president from among all eligible members, and be it further…

RESOLVED, that the council members shall each be assigned to one of three subcommittees at the prerogative of the chairperson such that each subcommittee shall have four members, with said subcommittees to be named the Programs Subcommittee, Entertainment Subcommittee and the Exhibits Subcommittee, and their specific areas of jurisdiction and responsibility to be consistent with those suggested by their names, subject to the direction of the chairperson. FINANCIAL IMPLICATION:   – $2,500 –       

RESOLUTION #12     
ADOPTED
(House of Delegates) RESOLVED, that the LDA revise the policy regarding the LDA student award section in the manual Policies and Mandates of the House of Delegates as follows:

 AWARDS
A.    It shall be the policy of the Louisiana Dental Association to present an award to the graduating senior of the LSU Dental School who best represents and conducts his/her life in accordance with the ideals of the profession of dentistry, and who has demonstrated a willingness to be involved with organized dentistry.  The winner of the award shall be selected in advance by a committee composed of the LDA President, the Chairman of the LDA Council on Government Affairs, and the LDA Executive Director Dental School Department Heads, and chaired by the Dean of the Dental School.  A monetary prize of $250 shall be presented with the award.

RESOLUTION #13      

ADOPTED (House of Delegates) RESOLVED, that Chapter I, Section 50 of the LDA Bylaws be amended to read as follows:

CHAPTER I – MEMBERSHIP AND DUES

Section 50:  Assessments, Dues and Reinstatement

A.–H. [No changes]

  1. Members Elected After July 1 and October 1:  Those members elected to active membership in this Association after July 1, except for those where membership has lapsed for failure to pay the current year’s dues and/or assessments, shall pay one half (˝) of the current year’s dues and assessments, and those elected after October 1, shall be exempt from the payment pay one-quarter (1/4) of the current year’s dues and assessments on a one-time only basis; except that a student member, upon classification as an active member by a constituent society, shall pay no further dues and assessments for the remainder of the calendar year in which the member was entitled to the benefits of student membership.

And, be it further…

RESOLVED, that in order that this change might be implemented in time to benefit non-members who are victims of Hurricanes Katrina and Rita, the LDA Board of Directors hereby adopts the above mentioned Bylaws change as an emergency policy provision to become effective immediately upon adoption of this motion, and be it further…

RESOLVED, that all LDA component societies be urged to adopt similar changes.

RESOLUTION #14    

ADOPTED (House of Delegates) RESOLVED, that Chapter VI, Section 10 of the LDA Bylaws be amended as follows:

  1. The Annual House of Delegates Meeting shall begin on or about the third Saturday in March convene at a place and time designated by the Board of Directors that affords adequate opportunity for the House of Delegates to dispense with all matters of business for that year that may appropriately come before it.
