Treating Challenging Patients with Richard Small, J.D.
Course Description: Dealing with challenging patients is part of dentistry. Because every situation is different, there is no “standard” way of addressing these issues. This course will review some of the common problems that dentists are confronted with in everyday practice. Withdrawing from care and patient abandonment will be discussed in detail and actual cases will be presented to illustrate how to handle these situations from a legal and ethical perspective. Standard risk management principles, such as communication, documentation, and informed consent will also be discussed. Supervised neglect will be addressed in periodontal situations, and implant, orthodontic, and extraction cases will be presented and risk management principles offered to help reduce your liability and provide better, safer care for your patients.
Course Objectives - Upon completion of this course, participants should be able to:
- Understand discussed risk management strategies and apply those strategies to situations that arise in everyday practice.
- Understand the legal and ethical considerations in obtaining informed consent, withdrawing from care,patient abandonment, and supervised neglect cases.
- Understand the importance of the patient/doctor relationship and how the overall relationship contributes to patient care, outcomes, and potential liability issues.
- Discuss the importance of documentation, what to include, and how it is your best defense in a claim or lawsuit.
Richard Small practices law in Michigan. He spent the first 20 years of his law practice defending dentists in court in Michigan and other states. He became an insurance agent for OMSNIC and Fortress in 2000. Small is the executive director and general counsel for the Michigan Society of Oral and Maxillofacial Surgeons, and the Great Lakes Society of Oral Surgeons. He also represents the Council of Michigan Dental Specialties.
